TAR Salerno suspends Agropoli building amnesty denial

The Regional Administrative Court (TAR) of Campania, Salerno section, has issued an ordinance in favor of Società Ermes Accoglienza S. r. l., suspending the effectiveness of a denial issued by the Municipality of Agropoli regarding a building amnesty request.

The dispute concerns a property located in the Moio area on Via Fontana Saracena. The municipal administration had previously issued a definitive rejection of the application submitted under Law 47/1985. The court ruled that there are sufficient grounds to grant the precautionary request, ordering the municipality to conduct a new evaluation of the technical investigation within 60 days.

The merits of the case will be discussed during a hearing scheduled for February 17, 2027. Legal costs for the precautionary phase have been offset between the parties.
