TAR Veneto orders Ministry of the Interior to re-evaluate police officer transfer request
The TAR Veneto (Veneto Regional Administrative Court) has ordered the Italian Ministry of the Interior to re-evaluate a request for a temporary transfer made by a police officer. The officer, currently serving at the Belluno police headquarters but originally from the province of Agrigento, requested a transfer to Palma di Montechiaro or Sciacca to assist his minor child.
The original request was denied by the Ministry, citing a lack of available positions in the requested locations and the operational needs of the Belluno headquarters. However, court documents obtained through access to records suggest that there are no staffing shortages in Belluno and that positions are indeed available in the requested Agrigento locations.
The court ruled that denials regarding requests related to the care of minor children must be supported by specific investigations and precise motivations rather than generic formulas. The Ministry has been given 60 days to re-examine the application, aiming to balance service requirements with the protection of the family unit.
