Tasmanian tribunal halts workers' compensation for rape victim

The Tasmanian Civil and Administrative Tribunal (TASCAT) has ruled that a labour hire company can pause workers' compensation payments to a farmhand who was raped in employer-provided housing.

The victim, identified in tribunal documents as NO, was placed in a cabin arranged by Tasmanian Labour Solutions while awaiting the start of the farm season. She reported that a male colleague entered her room and assaulted her while she was sleeping on November 15, 2025. Following the attack, she sought medical treatment and later filed a workers' compensation claim in May 2026 for post-traumatic stress disorder.

The employer challenged the claim, arguing that the assault was an independent criminal act and not directly linked to the victim's specific job duties. Under Tasmanian law, a mental health condition must be primarily caused by job duties to qualify for coverage. While the victim's legal team argued the injury resulted from employment conditions because she was in required housing, the tribunal ruled the assault was not directly linked to her employment duties.
