Telangana High Court allows trial in Nizam VII property dispute
The Telangana High Court has dismissed a civil revision petition challenging the continuation of a partition suit involving properties belonging to the seventh Nizam of Hyderabad, Mir Osman Ali Khan. The petition, filed by Azmet Jah and Shekhar Jah, sought to dismiss the plaint, but the court ruled the challenge was “devoid of merit.”
The lawsuit was initiated by Nawab Mir Najaf Ali Khan, a grandson of the late Nizam, seeking the partition and separate possession of five significant properties: Falaknuma Palace, Chowmahalla Palace, Purani Haveli, King Kothi Palace, and the Harewood and Cedars Bungalow in Tamil Nadu. The suit also includes a request to declare a sale deed related to the King Kothi/Nazri Bagh property as void and illegal.
Justice P Sam Koshy noted that the court’s supervisory jurisdiction under Article 227 cannot function as an appellate jurisdiction. The court further determined that disputes regarding court fees and the specific shares or possession of the parties must be resolved through evidence presented during the trial.
