Telangana High Court issues rulings on arrest protection and legal safeguards

The Telangana High Court has issued two significant rulings involving legal safeguards and arrest protections.

In a cocaine possession case, the court set aside a man's conviction, ruling that the police failed to prove he was individually and meaningfully informed of his rights under Section 50 of the NDPS Act. The court noted that a common notice was served to multiple accused individuals rather than individual notices, which undermined the statutory safeguard requiring persons to be informed of their right to have searches conducted before a Gazetted Officer or a Magistrate.

In a separate matter, the court directed police not to arrest BRS social media convener Manne Krishank regarding a case involving a social media post. Justice T Madhavi Devi ordered that the police issue a notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) and instructed Krishank to cooperate with the investigation. The case stems from a post concerning an incident at the Saifabad police station.
