Telecommunications operator ordered to pay R$ 641,000 for improper TV charges

A telecommunications operator has been ordered to pay more than R$ 641,000 following a class action lawsuit regarding improper charges for subscription television services in Campo Grande, Mato Grosso do Sul.

The lawsuit identified 3,424 affected consumers. While 1,664 customers received direct restitution, 1,760 individuals did not claim their compensation within the legal timeframe. Consequently, the Public Ministry utilized the ‘fluid recovery’ mechanism, which allows remaining funds from class actions to be redirected to a public fund dedicated to protecting collective consumer rights.

The funds will be transferred to the State Consumer Defense Fund (FEDC/MS). The company had previously challenged the execution of the sentence and the calculation criteria through the Mato Grosso do Sul Court of Justice and the Superior Court of Justice, but the requirement for payment was upheld.
