Terni court rejects immediate suspension of Farmacia Sabbione closure

The Regional Administrative Court (TAR) of Terni has rejected a request for the immediate suspension of the closure of Farmacia Sabbione srl, located on via Bartocci. The decision follows a resolution by Usl Umbria 2, approved on September 7, which mandated the cessation of the pharmacy's operations.

The legal dispute stems from a previous ruling by the Council of State that modified the pharmacy's status and supported the healthcare authority's planning decisions. Farmacia Sabbione, represented by attorney Marzio Vaccari, challenged the decision, seeking to annul the resolution and halt all connected administrative acts, including legal opinions used by the health authority that were not made available to the company.

The TAR president, Pierfrancesco Ungari, noted that the evaluation of precautionary needs must balance opposing interests in light of the Council of State's definitive ruling. As the closure proceeds, the Municipality of Terni may need to conduct further investigations to ensure pharmaceutical distribution coverage in the affected area.
