Terni municipality ordered to pay Atc for missed transport fee adjustment
The Tribunal of Terni, presided by Judge Dorita Fratini, ruled that the Comune di Terni must pay Atc & Partners Mobilità €158,674 plus VAT and legal costs. The payment stems from the municipality’s failure to apply the contractually mandated annual inflation‑indexed adjustment (TIP) to public‑transport fees after 2018, despite a 2005 agreement that was reaffirmed in 2012 and 2013.
The court found the municipality acted in bad faith by unilaterally altering service conditions without an agreement, violating a clause intended to preserve the economic balance of the service. The judgment allows the municipality to use the off‑balance‑sheet debt procedure under article 194 of the TUEL to settle the amount. The decision may be appealed, but for now the municipality is obliged to compensate Atc for the lost adjustment.
