Tesorería General de la República appeals CAE collection ruling
The General Treasury of the Republic (TGR) has issued a clarification following a ruling by the La Serena Court of Appeals regarding the State-Guaranteed Loan (CAE). The court granted a protection resource based on an alleged ‘double collection route’ involving both administrative collection by the TGR and civil lawsuits for the same debt.
The TGR maintains that this is not a duplication of charges but a mandatory legal sequence. According to the Treasury, the law requires creditor banks to exhaust civil litigation first; if funds are not recovered, the state guarantee is activated, prompting the TGR to initiate its own collection procedures to recover public resources.
The TGR noted that the majority of similar legal challenges in the country have been decided in its favor, citing that out of 2,904 protection resources filed nationwide, the TGR has won 1,028 cases. In La Serena, the TGR has won 76 out of 84 cases. The institution announced it will appeal the La Serena decision to the highest court to seek a reversal.
