Teva Pharmaceuticals faces antitrust investigation

The Competition Authority has launched an investigation into Teva İlaçları Sanayi ve Ticaret AŞ, Teva Pharmaceuticals Europe B.V., and Teva Pharmaceutical Industries Ltd. The probe follows a preliminary inquiry into whether the pharmaceutical company violated competition laws by restricting generic competition.

The investigation focuses on the strategic use of ‘evergreening’ or split patent procedures. Specifically, authorities are examining whether the company filed additional patents regarding production methods and dosage regimens after the protection period for its primary molecule patents expired. This practice is being scrutinized to determine if it was intended to hinder competitors from entering the market.

Additionally, the investigation will look into whether the company created a misleading image regarding the efficacy and safety of rival products before health authorities. The company holds patented products in fields such as neurology and immunology. The decision to launch an investigation does not inherently imply that the companies have violated the law or will face sanctions.
