Texas court upholds death sentence for Melissa Lucio

The Texas Court of Criminal Appeals has rejected a previous ruling that had declared Melissa Lucio innocent in the 2007 death of her two-year-old daughter, Mariah. Lucio, who has spent over 15 years on death row, was convicted in 2008 for the fatal beating of her child.

Her defense team has consistently maintained that the child's death was an accident and that her confession was obtained through coercive interrogation. While a 2022 appellate panel had previously ordered a new trial or her release, the Cameron County District Attorney appealed that decision. A full bench of judges has now reversed that ruling by a majority vote, stating the evidence was insufficient to overturn the original conviction.

Legal representatives for Lucio, including lawyers from anti-death penalty organizations, stated they will continue their efforts. Potential next steps include appealing to the United States Supreme Court, seeking clemency from Texas Governor Greg Abbott, or presenting new forensic evidence.
