Texas drag show ban struck down by federal judge

U.S. District Judge David Hittner has struck down Texas Senate Bill 12, a 2023 law intended to restrict public drag performances. The judge ruled that the legislation violates the First Amendment and constitutes an unconstitutional restriction on free speech.

Hittner noted that the law’s language regarding performances that appeal to a ‘prurient interest in sex’ is unconstitutionally vague. He suggested the vagueness could allow for the selective targeting of performances deemed erotic. In his ruling, the judge referenced country music icon Dolly Parton, noting that her flamboyant style and image might be subject to such interpretations under the law’s current wording.

The ruling prevents Texas Attorney General Ken Paxton from enforcing the statute.
