Texas law limits neighborhood power to block new housing

A proposed 64-unit affordable housing development in a wealthy South Austin neighborhood is proceeding despite strong opposition from local homeowners. Residents argued that the project, which includes a preschool, would be too tall, clash with the character of existing single-family homes, and increase traffic congestion.

In previous years, a formal petition signed by 29 property owners would have likely blocked such a project. However, the development is moving forward due to the impact of Texas House Bill 24. This state law, part of a broader legislative effort to address the state's housing shortage, effectively dismantled a Jim Crow-era statute that granted nearby property owners significant power to obstruct new construction.

Texas is currently facing a shortage of homes, leading to high rents and property prices. State lawmakers have responded by loosening local regulations to facilitate more construction and reduce the influence of neighborhood opposition to new developments.
