Texas lawmakers debate regulation of prediction markets

Texas lawmakers are evaluating whether prediction markets should be classified as federally regulated financial derivatives or treated as gambling subject to state oversight. The Texas Senate State Affairs Committee recently held hearings featuring opposing testimony from industry representatives and gambling advocates.

Representatives from prediction platforms, including Kalshi, argued that these markets function as financial instruments rather than gambling. Kalshi’s head of enforcement and legal counsel, Robert DeNault, advocated for federal regulation rather than state-level restrictions.

Conversely, the American Gaming Association (AGA) contended that wagering on event outcomes is indistinguishable from gambling. AGA spokesperson Tres York noted that prediction markets often lack the stringent customer protections found in regulated sportsbooks. Lawmakers expressed skepticism toward the industry's arguments, with some comparing potential federal regulation to government overreach in matters traditionally reserved for the states.
