Texas lawmakers examine legal status of prediction markets
Texas lawmakers are examining the legal implications of prediction markets, which operate in a regulatory gray area compared to traditional sportsbooks. While sports gambling remains illegal in Texas, prediction markets are licensed by the Commodity Futures Trading Commission (CFTC) rather than being regulated under state gambling laws.
Unlike traditional sportsbooks that profit from customer losses, prediction markets charge a small fee for each trade. However, the trades offered often resemble sports wagers. This has led to tension with traditional sportsbooks, which view these markets as a way to bypass state restrictions.
Legislative committees in both the Texas Senate and House have recently met with experts to discuss these markets. Recent reports indicate that Kalshi contributed funds to Ken Paxton’s PAC and his Senate campaign. The legal status of these markets remains a complex issue that may eventually reach the Supreme Court.
