Texas man faces competency evaluation after deputy assault charge

A competency evaluation has been ordered for Delano Davis, a Texas man accused of assaulting a Smith County deputy during an altercation near Flint-Gresham on June 21. Davis faces charges of assault on a peace officer and attempting to take a weapon from an officer.

According to official affidavits, the incident began when a deputy responded to reports of a man walking in front of traffic. While the officer was checking Davis's record, Davis allegedly opened the patrol vehicle's passenger door and began throwing items onto the floorboard. The situation escalated when Davis reportedly became fixated on the deputy's firearm and attempted to reach for it.

The deputy deployed a Taser multiple times during the struggle. Authorities state that Davis continued to fight, attempting to grab items from the officer's belt and striking the deputy in the face, which broke the officer's glasses. The evaluation was requested by Davis's defense team.
