Thailand Constitutional Court to rule on election ballot legality

Thailand’s Constitutional Court is set to rule on the legality of the February 8 general election, specifically addressing whether the use of barcodes and QR codes on ballot papers violated voter secrecy. The challenge, initiated by a petition from the ombudsman, argues that these technological features could allow for the identification of individual candidate and party choices.

The Election Commission has defended the codes, stating they were implemented for security purposes to prevent fraud and that voter identity remains protected because ballot stubs are stored separately. The February election resulted in a decisive victory for Prime Minister Anutin Charnvirakul’s Bhumjaithai Party, which secured more than 290 of the 500 parliamentary seats.

A ruling against the legality of the ballots could potentially annul part or all of the election results. While some legal analysts suggest a dismissal of the petition is the most likely outcome, the court has a history of delivering verdicts that have dissolved major parties and voided previous elections.
