Thailand extends social security benefits to all legal spouses

The Thai government has confirmed that social security benefits will be extended to all legally married spouses regardless of gender, following the implementation of the Marriage Equality Act. This legislation updates the Civil and Commercial Code by replacing the definition of marriage from “man and woman” to “two persons.”

Under the Social Security Office guidelines, legally registered same-sex spouses are entitled to several benefits, including death grants, funeral expenses, and old-age lump-sum payments. Specifically, spouses can claim a flat-rate funeral expense of 50,000 baht. In the event of death, if no beneficiary has been designated in writing, the death grant will be distributed to the legally registered spouse, parents, or children according to established priority levels.

For those under Sections 33 and 39 of the Social Security Act who die before receiving an old-age pension, heirs are entitled to a lump-sum payment consisting of accumulated funds and returns. The distribution includes portions for legal children, the registered spouse, and living parents. Government officials advise citizens to prepare necessary documentation and designate beneficiaries in writing to ensure rights are protected according to their intentions.
