Thailand intensifies crackdown on property ownership and short-term rentals

Thai authorities are intensifying crackdowns on property ownership and rental practices involving foreigners. In recent raids in Hua Hin and Koh Samui, police targeted luxury villa developments, arresting numerous foreigners, including Dutch nationals. The investigation focuses on companies used to bypass land ownership laws, where Thai shareholders hold nominal stakes without actual investment or control—a practice now being prosecuted as real estate fraud.

Parallelly, regulations regarding short-term rentals like Airbnb are under scrutiny. Under the Thai Hotel Act, renting out residential condominiums for short periods (less than 30 days) can be legally classified as operating an unlicensed hotel. Additionally, the Condominium Act and individual building management rules often prohibit commercial activities in residential units, meaning owners must verify specific complex regulations to avoid legal issues.
