Thailand SEC approves Bitcoin and Ether ETF framework
The Thailand Securities and Exchange Commission (SEC) has finalized a regulatory framework for locally listed cryptocurrency exchange-traded funds (ETFs), set to take effect on October 16, 2026. The new rules permit asset managers to launch funds tracking Bitcoin and Ether, which will be traded exclusively on the Stock Exchange of Thailand (SET).
Under the regulations, these ETFs must be passively managed and maintain an average net exposure of at least 80% to a single underlying cryptocurrency throughout each accounting year. To ensure security, all assets must be held with digital asset custodians licensed by the Thai SEC.
To protect investors, the framework includes several restrictions: securities firms are prohibited from providing margin loans for ETF purchases, and retail investors are initially barred from accessing foreign crypto ETF-linked products through local brokers. Additionally, investors must complete mandatory education and provide a formal acknowledgment of the risks associated with these digital assets before trading.
