Thuringia wind energy regional plan faces court challenge
The Higher Administrative Court in Weimar is reviewing the “Windenergie Ost” regional plan for East Thuringia. The legal challenge focuses on whether wind power construction can be excluded from landscape protection areas.
Two companies filed a lawsuit after being prevented from building wind turbines on their properties because the land was not designated as a priority area. The case highlights increasing legal complexities in wind energy planning, a trend noted by legal experts as a nationwide phenomenon where regional wind energy plans are frequently overturned in court.
The court must determine if the regional plan adheres to the requirements set by the legislature regarding priority zones and prohibited areas.
