Tim Hukum Merah Putih seeks Constitutional Court review on pretrial rules
The Tim Hukum Merah Putih (THMP) has filed a judicial review with the Constitutional Court (MK) regarding pretrial provisions in the new Criminal Procedure Code (KUHAP). The legal team is requesting that the court limit pretrial motions to a single filing to ensure legal certainty.
THMP coordinator C Suhadi argued that allowing repeated pretrial motions could obstruct the handling of legal cases and violates the principles of simple, fast, and low-cost justice. The group specifically highlighted Article 163, Paragraph 1, Letter E of the KUHAP, which they claim allows for repetitive filings. They proposed that all contested objects, such as seizures, suspect designations, and detentions, should be submitted simultaneously in one motion.
