TJDFT issues rulings against GOL and Bradesco Saúde

The Court of Justice of the Federal District and Territories (TJDFT) has issued two significant rulings regarding consumer rights and service obligations.

In the first case, the court upheld a decision requiring GOL Linhas Aéreas S.A. to pay moral damages to two passengers. The individuals were held inside an aircraft for approximately four hours due to a technical failure on a flight to São Paulo. One passenger, who has a hearing impairment and was recovering from surgery, reported that the lack of adequate assistance worsened their condition. The court rejected GOL's argument that the delay was a necessary safety measure, classifying the technical failure as an internal business risk.

In a separate ruling, the TJDFT ordered Bradesco Saúde S.A. to cover the costs of an insulin pump and necessary supplies for a patient with type 1 diabetes. The court overturned a previous lower court decision, noting that medical reports confirmed the technology was essential for glycemic control after conventional treatments failed. The ruling aligns with Superior Court of Justice (STJ) precedents regarding the immediate application of laws that prevent health insurance providers from denying coverage for such essential medical technologies.
