TJDFT orders refund for breach of real estate contract agreement

The 3rd Civil Chamber of the Court of Justice of the Federal District and Territories (TJDFT) has ordered JC Compra e Venda de Imóveis Ltda. and Clubcia Viagens e Vantagens Ltda. to refund R$ 4,669.64 to consumers.

The ruling follows a breach of an agreement intended to terminate multi-ownership contracts for a real estate development in Florianópolis. Consumers had sought to rescind their contracts due to delays in property usage, but the companies failed to fulfill the agreed-upon refund.

The court rejected an initial decision that suggested the breach required a separate lawsuit, noting that the current proceedings were specifically for the collection of the agreed amount. The rapporteur emphasized that the companies failed to provide proof of payment and that requiring a new action would violate principles of procedural economy. Both companies were held jointly liable as part of the same supply chain.
