TJDFT upholds conviction of domestic worker for qualified theft

The 1st Criminal Chamber of the Court of Justice of the Federal District and Territories (TJDFT) has upheld the conviction of a domestic worker for qualified theft involving an abuse of trust. The defendant was sentenced to two years of imprisonment in an open regime, with the sentence being replaced by restrictive rights penalties and a fine.

The theft involved a Samsung Galaxy A03 mobile phone, various pieces of jewelry, and other objects taken from the victim's residence. While the defendant's long-standing relationship of trust with the employer initially diverted suspicion, a Civil Police investigation revealed that the stolen phone was being used by a telephone line registered in the defendant's name and subsequently by a line linked to her son.

During a search of the defendant's residence, police also recovered a pendant identified by the victim as one of the stolen items. The court rejected defense arguments for acquittal or reclassification of the crime to receiving stolen goods, ruling that the evidence consistently proved the defendant utilized her position of trust to commit the theft.
