TJRN defends legality of magistrate payments under existing rules

The Court of Justice of Rio Grande do Norte (TJRN) has clarified that magistrate payments made in April 2026 adhered to the national regulatory guidelines in effect at that time. According to the court, these payments followed instructions from the National Council of Justice (CNJ) and the National Council of the Public Ministry (CNMP), aligning with parameters established by the Supreme Federal Court (STF).

The clarification follows recent STF decisions in August 2026, which introduced new parameters for handling indemnity installments paid to magistrates. The TJRN noted that the April payroll was based on a March circular from the CNJ, which advised maintaining previous parameters and specifically addressed the prohibition of indemnifying up to 30 days of unused vacation.

Following subsequent clarifications from the STF in July and August 2026, the TJRN stated it has begun implementing the new parameters set by the Supreme Court, including the individual identification of relevant data.
