Tokenization sector faces legal and operational challenges

The real-world asset (RWA) and tokenization sectors are facing scrutiny regarding legal protections and operational stability. Jeff Amico, COO of GensynAI, warns that investors in RWA credit vaults may lack direct creditor rights. In many current structures, users receive yield-bearing stablecoins governed by a platform's terms of service, but the underlying loans and collateral are held by separate entities. This means investors may have no enforceable claim against the actual borrowers or collateral, essentially relying on the platform to fulfill payments.

Simultaneously, the tokenized stock market has faced significant challenges. Despite a more favorable regulatory environment in the US, recent attempts to offer tokenized shares of private companies like SpaceX have failed. These collapses were not caused by hacks or market crashes, but rather by platforms failing to have sufficient actual shares on hand to meet demand, highlighting a lack of robustness in the underlying product infrastructure.
