Tony O’Doherty appeals cancellation of real estate licence

Brisbane real estate agent Tony O’Doherty is appealing a decision by the Office of Fair Trading to cancel his professional licence. The cancellation follows O’Doherty’s guilty plea to a 2013 one-punch assault that occurred in Ireland, an incident which resulted in the victim suffering a fractured skull and a brain bleed.

O’Doherty, formerly the principal at McGrath Bulimba, received a two-year fully suspended sentence for the overseas assault. His legal team is challenging the application of the Property Occupations Act 2014, which deems individuals unsuitable for a licence if they have been convicted of an offence within the previous five years.

Barrister Rob Anderson KC argued that the impact of the Irish conviction on O’Doherty’s livelihood was not considered by the Irish court and questioned whether a foreign offence should be factored into Queensland law. Conversely, the Department of Justice, represented by Angus Scott KC, maintained that the legislation is essential for the protection of the community and consumers, particularly regarding offences involving violence.
