Torchy’s Tacos sued for $250,000 over cow tooth in food

A customer in Austin, Texas, has filed a lawsuit seeking up to $250,000 against Torchy’s Tacos and Success Foods Management Group after discovering a cow tooth in a beef barbacoa taco. The incident occurred on June 9, 2026, at the restaurant’s South Congress Avenue location.

Nohemi Castillo, the plaintiff, alleges that she nearly swallowed the object and subsequently required medical attention and prescription medication. The lawsuit cites negligence, breach of implied warranties, and violations of the Texas Deceptive Trade Practices Act and the Food Safety Modernization Act, arguing the chain failed to properly inspect meat to prevent foreign objects from entering the food supply.

Torchy’s Tacos confirmed through a spokesperson that the object was indeed a cow tooth. The company stated that the barbacoa is made from natural beef cheek provided by a vendor and noted that while rare, such occurrences can happen during meat processing. The chain indicated it is working with its supplier to reinforce internal procedures to prevent future incidents.
