Trademark developments in Colombia and Peru
In Colombia, the Superintendencia de Industria y Comercio denied the registration of the brand ‘Tostichomi’ following an opposition by Ferris Enterprises. Ferris Enterprises argued that the requested mark infringed upon their ‘Tosti’ brand family, creating a risk of consumer confusion. Although the applicant, Victoria Eugenia Mesa Gómez, argued that phonetic and graphic differences—such as unique typography and a banana leaf graphic—prevented confusion, the authority ruled that the signs were orthographically and phonetically similar enough to be confusingly similar.
In Peru, several major consumer companies have filed for new trademark registrations with Indecopi. Supermercados Peruanos, the operator of Plaza Vea, Vivanda, Mass, and Makro, has applied to register ‘Amadía’ for cereals, including breakfast cereals, muesli, and granola, as part of an expansion of its private label portfolio. Additionally, Bimbo and Mifarma have submitted trademark applications related to food, vitamins, and supplements. These filings indicate potential product expansions but do not confirm specific launch dates or new product details.
