Brazil judicial updates: Mandate revocations and ineligibility rulings

Brazil's electoral and judicial systems are managing several high-profile cases involving political mandates and administrative legality.

In Pará, the Regional Electoral Court (TRE-PA) voted to revoke the mandates of Abaetetuba Mayor Francineti Carvalho and her vice-mayor due to allegations of abuse of economic and political power during the municipal elections. The defense has filed for a stay of execution to maintain their positions during the appeals process.

In Ceará, a judge revoked the mandates of the Mayor and Vice-Mayor of Santana do Acaraú following investigations into the misuse of public resources and media for electoral purposes. The decision includes an eight-year ineligibility period for the mayor.

Regarding broader legal standards, the President of the Superior Electoral Court (TSE), Kassio Nunes Marques, clarified that the rejection of public accounts by the Federal Court of Accounts (TCU) does not automatically result in electoral ineligibility. He emphasized that the TSE must individually verify if specific legal requirements for ineligibility are met.

In Bahia, the State Court of Justice (TJBA) ruled that a 2015 law redefining municipal boundaries is unconstitutional but granted a 12-month grace period before the decision takes effect to prevent legal and administrative instability.

Separately, in the business sector, the Labor Court suspended mass layoffs by Grupo Casas Bahia following the company's recent judicial recovery filing for debts totaling R$ 17.3 billion.
