US proposes $103,265 permanent fee for H-1B visas FAST-MOVING
The Trump administration, through the Department of Homeland Security (DHS), has proposed a regulation to make a $103,265 fee for new H-1B visa applications permanent. This move follows a previous temporary fee that was blocked by a federal judge in June, who ruled the charge illegal.
The proposed fee would apply to cap-subject H-1B petitions, including those for advanced degree holders, but would not apply to visa renewals or foreign nationals already in the United States on student visas. This represents a massive increase from the historical fee range of $2,000 to $5,000.
The administration argues the fee is necessary to recover interagency costs and to prioritize American workers. Conversely, business groups and legal challengers argue the executive branch lacks the authority to impose such taxes without Congressional approval. The rule, which has been published in the Federal Register for a 30-day public comment period, could be finalized by the end of the year.
