Trump administration proposes citizenship disclosure on IRS tax forms

The Trump administration is proposing changes to the annual IRS Form 1040 that would require taxpayers to disclose their citizenship or legal work authorization status. The draft form includes mandatory checkboxes for filers and their spouses to indicate whether they are U.S. citizens, U.S. nationals, or aliens lawfully authorized to work in the country.

Administration officials state the requirement aims to prevent unauthorized immigrants from claiming federal benefits and refundable tax credits, potentially saving up to $2 billion. However, tax and immigration experts express concern that the measure serves as an immigration enforcement tool. Critics, including the Center for Taxpayer Rights, argue the move could intimidate undocumented immigrants into avoiding the tax system altogether to evade detection, despite the fact that many existing tax credits already require a Social Security number.

Legal and privacy advocates warn that the change shifts the IRS from a revenue-focused agency toward an instrument of immigration policy. The proposal may face legal challenges regarding taxpayer privacy and the potential for data to be used by immigration enforcement agencies.
