Trump administration pursues legal challenges regarding transgender rights

The Trump administration is pursuing legal actions regarding transgender rights in two significant venues. In the Ninth Circuit Court of Appeals, a three-judge panel ruled that the Department of Justice is permitted to subpoena the medical records of transgender youth seeking therapy. The majority opinion, written by Judge Carlos Bea, argued that courts should not override presidential judgment on matters of public policy, despite arguments that such subpoenas may violate HIPAA protections.

Separately, the administration has petitioned the U.S. Supreme Court to uphold an executive order banning transgender Americans from military service. This appeal follows a federal court ruling in Washington, D.C., which had sided with transgender service members. Solicitor General D. John Sauer argued that the military's authority to determine service eligibility is a matter of exceptional importance. The Supreme Court is expected to decide this fall whether to hear arguments in the case.
