Federal judge blocks Trump mail-in voting order nationwide
A federal judge in Boston has expanded a nationwide injunction to block President Donald Trump’s executive order regarding mail-in voting restrictions. U.S. District Judge Indira Talwani ruled on Tuesday that the U.S. Postal Service (USPS) cannot enforce provisions of the March executive order, which aimed to tighten rules for mail-in ballots ahead of the November 2026 midterm elections.
The order, titled ‘Ensuring Citizenship Verification and Integrity in Federal Elections,’ directed the USPS to only mail ballots to individuals appearing on state-specific eligible voter lists and instructed the Department of Homeland Security to provide states with lists of eligible voters. It also directed the Justice Department to investigate officials who issue ballots to ineligible voters.
Judge Talwani’s decision expands upon a June ruling that had only applied to 23 states and the District of Columbia. In her decision, she emphasized that changing election rules less than 90 days before an election could cause significant disruption and chaos. She further noted that the executive branch lacks the authority to unilaterally regulate election processes, a role belonging to Congress and the states.
The Trump administration has filed an emergency request with the U.S. Supreme Court to stay the injunction. Solicitor General John Sauer argued that the lower court’s orders will prevent the government from implementing necessary election integrity policies before the November elections, causing irreparable harm.
