Trump extends $100,000 H-1B visa fee and increases employer scrutiny

President Donald Trump has extended a $100,000 fee for certain H-1B visa applications for another year, a measure set to remain in effect until September 21, 2027. The White House stated that the 2025 fee implementation has already led to a 92% reduction in H-1B registrations by large IT outsourcing firms and a nearly 97% decrease in consular processing.

In addition to the fee renewal, a new executive order directs the Departments of State, Labor, and Homeland Security to increase scrutiny of H-1B applications from employers that have recently conducted or have planned layoffs of similarly situated US workers. The Labor Department's Wage and Hour Division has been given a 30-day deadline to review existing labor condition application data to determine if further action against sponsoring employers is necessary.

The measures face ongoing legal challenges, with a federal judge previously ruling the fee illegal; the case is currently under review by a Boston-based appeals court. While the administration maintains these steps are necessary to protect the American workforce and national security, business groups and advocacy organizations like the Foundation for India and Indian Diaspora Studies (FIIDS) have cautioned that such restrictions could impact American innovation and the ability to recruit highly specialized global talent.
