TSE seeks consensus on AI regulations following Bolsonaro deepfake controversy
The Brazilian Superior Electoral Court (TSE) is moving to regulate the use of artificial intelligence in upcoming elections. TSE President Kassio Nunes Marques has called for a meeting to establish consensus on how to judge AI-related cases, following a legal challenge by the PT party. The dispute centers on a deepfake video used during a PL party convention, which featured a digital version of former president Jair Bolsonaro endorsing his son, Flávio Bolsonaro, for the presidency.
In response to these challenges, the TSE is pursuing several initiatives. It is expected to sign a memorandum of understanding with YouTube to allow users to register their faces and request the removal of deepfake content. Additionally, the court has established a Consultative Council on Informational Integrity to monitor disinformation and AI misuse.
Flávio Bolsonaro's legal team has argued against requiring explicit consent for AI-generated content, claiming that such a rule would stifle legitimate political satire and criticism. Meanwhile, public sentiment appears cautious; a CNT/MDA survey indicates that over 80% of Brazilians support some form of limits on AI usage in electoral propaganda.
