Argentina promulgates Inocencia Fiscal II tax reform law

The Argentine government has promulgated Law 27.826, known as Inocencia Fiscal II, to reform the tax system and encourage the integration of informal savings, such as 'mattress dollars', into the formal economy.

Key provisions include the elimination of previous income and asset caps—previously set at $1,000 million and $10,000 million respectively—for the simplified income tax regime. This regime is available to individuals and undivided successions that are tax residents in Argentina. Changes to this simplified regime are slated to take effect starting from the 2025 fiscal period.

The law also introduces an automatic 25% reduction in certain tax procedure fines for micro, small, and medium-sized enterprises (SMEs), individuals, and non-profit entities, provided they are not classified as Large National Taxpayers. Additionally, a 50% reduction is available for formal infractions committed before the law's enactment, subject to specific conditions regarding the payment of omitted obligations.

To prevent abuse, the law defines a 'significant discrepancy' as a situation where the tax authority (ARCA) identifies an increase in determined tax or a reduction in tax losses of at least 15% compared to the taxpayer's declaration.
