Tucumán municipal court decentralization deemed unconstitutional
A fiscal report issued by the Ministry Public Fiscal in Tucumán province concluded that the mayor's decree to decentralize the Municipal Fines Tribunal (Tribunal Municipal de Faltas) violates the provincial constitution.
The decree, signed by Mayor Rossana Chahla, transferred several judges to the municipal Transit and Cadastre departments. Former tribunal president Gerardo Augusto Poliche filed a complaint alleging that the measure infringes on judicial independence.
Matías Balardini, the administrative director of the Tribunal, defended the reform, stating it is intended to improve administrative control of infractions and bring services closer to citizens, not to strip judges of jurisdictional powers.
The fiscal opinion will be examined by the Chamber's Administrative Litigation Court (Sala III), which will determine whether to nullify the decree, potentially setting a precedent for municipal governance in Argentina.
