Turkey prepares reforms to end indefinite alimony
Turkey is preparing significant reforms to alimony laws as part of the upcoming 13th Judicial Package. Following a decision by the Constitutional Court to annul indefinite alimony, the proposed changes aim to amend Article 175 of the Turkish Civil Code to remove the term “indefinite” regarding poverty alimony.
Under the new regulations, alimony duration would be determined by a judge and must be at least three years, but should not exceed half of the total duration of the marriage. In determining the duration, judges will consider factors such as the age of the recipient, education, health status, economic capacity, and the impact on the payer's post-divorce life.
Exceptions are planned for specific circumstances. If the recipient is unable to work due to the other party's wrongful act, or if advanced age and lack of regular income due to a long marriage prevent self-sufficiency, a judge may grant a longer period. The package also aims to expedite divorce proceedings and appeal processes to reduce judicial delays.
