Turkish authorities impose heavier penalties for illegal balcony activities

With summer heat increasing the use of balconies in apartment buildings, Turkish courts are applying stricter enforcement of the Condominium Law (Article 18). The law obliges owners to avoid actions that disturb neighbors, and violations such as grilling that produces smoke, strong odors, or heat can lead to a ban on balcony barbecues and administrative fines of several thousand lira.

Noise complaints from late‑night conversations, loud music, or amplified phone calls on balconies are now prosecuted under the Traffic Violations Law and can also be pursued as a criminal offense for disturbing public peace. Residents who wash laundry or dump water from balconies risk civil liability for damage to lower‑floor property.

Throwing cigarette butts or other debris from balconies that ignites fire or damages neighboring belongings is classified as “damage to property” and “endangering public safety” under the Turkish Penal Code, carrying possible imprisonment in addition to fines.
