Turkey Constitutional Court annuls indefinite alimony provision

The Constitutional Court of Turkey has annulled the provision in Article 175 of the Turkish Civil Code that allowed for 'indefinite' poverty alimony following a divorce. The ruling, which follows an objection by the Antalya 12th Family Court, found that providing alimony without specific time criteria or measurable standards violates the Constitution by creating an excessive and unpredictable burden on the alimony payer.

The decision does not abolish poverty alimony entirely. Instead, it mandates that judges must determine the duration of alimony based on specific, predictable criteria such as the duration of the marriage, the age and health of the parties, and their ability to achieve economic independence.

To prevent a legal vacuum, the Court has postponed the implementation of this annulment for nine months. The new regulations are expected to take effect on June 30, 2027. During this transition period, the Grand National Assembly of Turkey is expected to enact new legislation to establish a clear legal framework for alimony duration and conditions.
