Turkish court ruling examines funeral attendance in divorce cases

A recent ruling by the Court of Cassation has sparked discussion regarding the legal implications of failing to attend a spouse's family funeral. Following a decision by an Ankara Family Court, a woman was found to be fully at fault in a divorce case because she did not attend her mother-in-law's funeral.

Attorney Orhan Bozdere clarified that while such an act does not automatically constitute grounds for divorce, it can be evaluated as a fault within the context of the Turkish Civil Code. The court considers various factors, including the presence of excuses, the history of the relationship, the continuity of the behavior, and the faults of the other spouse, to determine the degree of liability.
