Turkish courts rule on land registration disputes in Istanbul and Ayvalık

The Istanbul 4th Civil Court of First Instance (case No. 2023/318) heard a request to cancel and re‑register a 51 m² property in Fatih. The plaintiffs, representing several heirs, asked the court to declare the heirs missing under Article 588 of the Turkish Civil Code and to record the missing shares in the name of the Treasury. The court announced that anyone with knowledge of the heirs’ whereabouts must submit information within six months.

The Ayvalık 1st Civil Court of First Instance (case No. 2016/495, decision No. 2024/358) partially accepted a claim concerning a parcel in Küçükköy. The court ordered the cancellation of the title for a 6,844.44 m² forested portion and its registration to the Treasury, while rejecting the request for a 19,409.35 m² portion. The decision is appealable, and an appeal has been filed by the plaintiff’s attorney.
