Turkish legal guidelines address orphan pensions and inheritance rights
Legal frameworks in Turkey provide specific regulations regarding orphan pensions and inheritance disputes involving property transfers.
Under Social Security Institution (SGK) regulations, female orphans receiving pensions face specific conditions. For those subject to Law No. 5510, which applies to individuals starting work after October 1, 2008, the pension is discontinued if the recipient marries or begins working under SSK, Bağ-Kur, or civil servant status, whether domestically or abroad. For those under older Emekli Sandığı regulations, different service period limits may apply.
Regarding inheritance, Turkish law allows heirs to challenge property transfers made by parents during their lifetime if the intent was to deprive other heirs of their rights. This legal concept, known as muris muvazaası, occurs when a property is recorded as a sale in the land registry to disguise a gift. If a court determines that a transaction was a sham intended to circumvent inheritance laws, the title deed can be canceled and redistributed according to legal inheritance shares.
