According to court filings, Herro initially requested the establishment of a parenting plan and a determination of child support obligations, noting he has provided financial assistance since the birth of their children. He later withdrew this specific filing.

In a subsequent petition, Henry sought primary custody, stating she has served as the primary caregiver and decision-maker for their children. She requested that the court implement safeguards and parameters regarding the children's contact with Herro due to his “past behavior,” though she noted she omitted specific details to avoid public humiliation. Henry also highlighted the significant income disparity between the two parties, citing Herro's professional basketball salary.
