Tyler Robinson defense argues against death penalty in Charlie Kirk murder case

Defense attorneys for Tyler Robinson, the man accused of killing conservative activist Charlie Kirk, are arguing against the application of the death penalty. In a recent legal filing, lawyers stated that Robinson should not face capital punishment because his single shot hit the “intended target” and did not create a “high probability” of death to others, a requirement for the death penalty under Utah law.

The shooting occurred on September 10, 2025, at Utah Valley University in Orem during a campus debate. Prosecutors are seeking the death penalty, alleging that Robinson knowingly endangered thousands of people by firing a high-powered, scoped rifle from a rooftop vantage point. They argue that the crowd was within a “zone of danger” where a stray or ricocheting bullet could have caused mass casualties.

Robinson, a 23-year-old former apprentice electrician, has not yet entered a plea. While prosecutors claim to have “overwhelming” evidence, including DNA ties to the murder weapon and alleged confessions, the defense has questioned the reliability of the DNA testing and disputed the prosecution's claims regarding the defendant's political motivations.
