Tyler Robinson defense challenges death penalty in Charlie Kirk case

Attorneys for Tyler Robinson, who is accused of killing conservative activist Charlie Kirk at Utah Valley University in September 2025, are attempting to prevent the prosecution from seeking the death penalty.

The defense argues that the shooting does not meet the criteria for capital punishment under Utah law. Specifically, they contend that the bullet traveled above the crowd rather than through it, meaning Robinson did not place anyone other than Kirk in danger. They also dispute the prosecution's claim that political motives related to Kirk’s views on transgender ideology played a role in the shooting.

Prosecutors have filed a 19-page response opposing these motions, asserting that the evidence is sufficient to establish that Robinson created a “zone of danger” for thousands of people near the target. The state maintains that the use of a high-powered rifle and the presence of multiple bullets in the weapon demonstrate a willingness to risk lives, which serves as a legal aggravating factor for a death sentence.
