Defense attorneys for Tyler Robinson, accused of the September 2025 fatal shooting of conservative activist Charlie Kirk, have filed a motion to remove the death penalty as a potential sentence. The defense argues that prosecutors have failed to prove the shooting created a “high probability” of death to anyone other than Kirk, which is a required aggravating factor under Utah law for capital punishment.

Lawyers contend that the single shot fired from a rooftop vantage point hit its intended target and that evidence suggests the bullet traveled above the crowd rather than through it. They argue that the state has not established probable cause that Robinson knowingly created a great risk of death to others.

Prosecutors maintain that Robinson is eligible for the death penalty, alleging he knowingly endangered the crowd by firing a high-powered rifle and loading it with four rounds. They also suggest the killing may have been politically motivated, citing statements Robinson allegedly made to his roommate.

Judge Tony Graf is scheduled to hold a hearing on September 1 to decide if there is sufficient evidence for the case to proceed to trial. Prosecutors have until August 18 to respond to the defense's recent filings.
