Before cutting, owners should check whether the tree is protected by a Tree Preservation Order, as illegal removal of protected trees can attract fines up to £20,000, civil compensation claims and even criminal charges. If an agreement cannot be reached, the local council can provide a mediator, though the party may need to pay for the service. The guidance applies equally to roots that cause damage, which may also be cut back to the property line.
